Even with the support of 400 other photographers, it’s hard to believe, isn’t it.

    There clearly has been an infringement of copyright so Lara by rights should be compensated especially when the photo had a copyright to confirm this.

    Also publishing a picture (for financial gain) of a minor without a parent signed model release.

    I don't think it helps that flickR strips all the metatags out of images, either. So people are free to just steal the images, and then further down the line, if someone comes across the image somewhere else, and legitimately wants to use it, it's impossible to track down the original owner.

    It's theft, and regular people can help by crediting photographers when they share images - along with a link. flickR can help by not stripping out IPTC metadata.

    And finally, advertisers and photo editors can help by not using images that they are not sure they have clear rights to.

    They should've at least offered to pay her some royalties when finding out that she was the owner, if there was "nothing they could do." Especially after they found out she was a minor!

    This poor girl's photo has showed up other places too. I found it while browsing for a new blogger background. It was under the 'sexy' and 'vampire' tags. Poor kid.

    The blogger background was finally removed from the site and I haven't seen any remnants of it even, but still, it was up for a long time before it was reported.

    If she has received so much support from the community then she has two possible solutions... ask for contributions toward litigation and offer both thanks and refund from a certain win or, find a lawyer compassionate enough to do it on contingency. If it were watermarked then, it most certainly was edited out, which proves forgery. Aside from that, the girl in the photo was 14 years old at the time... TVX is distributing provocative images of an under-aged girl and it basically becomes an issue of possessing and distributing child pornography. Lawyers would eat this up in North America. The lesson here is that your images, once posted on the net, are fair game to anyone. The solution is to lower the resolution and reduce the output size of the image so it is unusable even at the size of a DVD cover.

    I had similar experience with Lara Jade Coton, even worse, the person who used my works is my cousin. He mentioned my name on the title of the album he has in deviantART. In short, the dispute settled, although I had to "swallow" the effects in my biz as a professional photographer...

    Not that i am trying to stir shit up - but this is NOT a pornographic image. so some of you gotta settle down a bit - it was used on the cover of a porno dvd yes - but its not DIRECTLY child pornography...this is why people need lawyers.

    i am not trying to say this is right, however i am just stating its not a child pornography photograph.

    if it was the case then flickr n stuff would not have allowed it on.

    from what ive herd - flicker have an agreement with imagestock company, and from what i seem to understand, i think these can get slapped on there without anything u can do about it.

    this is sorta like myspace, where its in the user agreements, that anything, as an artist, that you post on there, is theoretically their property.

    this does not mean that they will even do anything with the stuff. however when you agree to the terms, you give em the rights.

    so weather you watermark or whatever thing you do, thats how shit plays out.

    copyrights are over rated, and you never know when you are handing yer rights over....

    and SERIOUSLY, if i wanna take yer photo, and re edit it and use it, how would you even know or prove thats what i did....
